These Terms and Conditions (“Terms”) govern the use of the kovacsperformance.com website (the “Website”) operated by Kovács Martin, sole trader (“Provider”), and the online coaching services and training programs offered by the Provider.

By using the Website, or by using the services offered by the Provider, the user (“User”) accepts these Terms.

2. The services

The services offered by the Provider (“Services”) consist in particular of 1:1 online coaching, pre-built training programs, and subscription-based group online training programs.

The Website provides advance information about the content and key features of the Services. The specific types of Services and their exact content are available on a third-party platform, TrainHeroic (“TrainHeroic”): https://legal.trainheroic.com/terms-of-use.html

3. Using the Services

Purchases and subscriptions are completed through TrainHeroic. Links on the Website direct the User to TrainHeroic.

The operation of TrainHeroic’s technical platform, the management of a TrainHeroic user account, and the payment, billing and technical processes handled by TrainHeroic fall within TrainHeroic’s own area of operation. The Provider is not responsible for any errors occurring within them. This does not, however, affect the Provider’s responsibility for the professional content and delivery of the Services it provides. The Provider is responsible for the professional content of the training programs it creates, within the limits of applicable law.

A User interested in 1:1 online coaching may fill out an application questionnaire on the Website. The purpose of the questionnaire is to let the Provider learn in advance about the User’s training-related goals, experience, and other information needed to personalize the coaching.

The Provider is entitled to modify the content published on the Website, as well as the scope and terms of the Services available in the future. Such modification does not affect rights and obligations already arising under contracts already concluded.

4. Fees and payment

The prices shown on TrainHeroic’s own interface govern the current pricing of the Services.

Payment for the Services and related administration take place through the TrainHeroic platform, under the terms set out there.

Cancellation of subscriptions and refunds are governed by TrainHeroic’s own terms as in effect from time to time, without prejudice to the User’s statutory consumer rights.

5. User obligations

The User is obliged to:

• provide accurate and complete information when using the Services;
• train with due regard to their own health and physical condition;
• consult a doctor where necessary in the event of injury, illness, pregnancy, or any health circumstance materially affecting training;
• stop training in the event of pain, feeling unwell, or unusual symptoms, and seek professional help where necessary;
• use the training programs and other content provided to them for their own personal purposes only.

6. Health warning and liability

The User acknowledges that sporting and training activity carries an inherent risk of injury and other health risks.

The User must take part in training and follow the training program in a manner appropriate to their own health and physical capability.

The Services do not constitute a healthcare service, medical diagnosis, or treatment, and do not replace consultation with a doctor or other appropriate healthcare professional.

7. Intellectual property

The training programs, training plans, videos, texts, graphics and other content made available in the course of providing the Services are protected by copyright and other intellectual property rights.

The User receives a personal, non-transferable right to use this content.

Without the Provider’s prior written consent, the User may not, in particular, copy, sell, redistribute, make publicly available, or use the content for commercial purposes.

8. Data protection

The detailed rules on the processing of personal data are set out in the Privacy Notice available on the Website.

When using TrainHeroic, the data-processing rules available on the TrainHeroic platform apply.

9. Changes to these Terms

The Provider is entitled to unilaterally amend these Terms at any time.

The amended Terms take effect upon publication on the Website, or at the time specified there. Such amendment does not affect rights and obligations already arising under contracts already concluded, unless the law or an agreement between the parties provides otherwise.

10. Other provisions

These Terms and the Services provided by the Provider are governed by the laws of Hungary.

Questions or complaints regarding these Terms or the Services may be addressed to the Provider at: km.streength@gmail.com. A User qualifying as a consumer may, in the event of a consumer dispute, turn to the conciliation body (“békéltető testület”) competent for their place of residence or stay, and may also designate a different conciliation body in their request.

If the Provider is unable to perform its obligations related to providing the Service for a reason beyond its control, which it could not influence and is not attributable to it, this does not constitute a breach of contract. Such a force majeure event includes, in particular, war, civil unrest, strikes, riots, natural disasters, fire, explosion, interruption of electricity supply, failure or interruption of leased-line services, a state of emergency, epidemic, or any other similarly unavoidable situation. In the event of force majeure, the Provider is released from liability for non-performance or partial non-performance of its obligations only to the extent and for as long as force majeure materially hinders or makes performance impossible.

Effective: from 27 August 2026 until withdrawn and/or amended.
